A marital separation agreement, also known as a property settlement agreement, or marital settlement agreement, is simply a written contract dividing your property, spelling out your rights, as well as settling problems such as alimony and custody. When executed and witnessed properly, it is an enforceable contract between the parties, but is not in itself an undertaking to become divorced. Most parties ultimately do file for divorce, at which time an Agreement would be "incorporated" into the eventual divorce judgment.
Our Marital Separation Agreement is state-specific. It is a comprehensive agreement that provides many choices, whether you have children or no children. Here is a partial list of sample clauses:
This Parenting Plan document is to be used in conjunction with a divorce proceeding involving minor children. It establishes the final parental rights and responsibilities of the mother and father and is incorporated into the divorce decree. The plan details parenting schedules, decision making, residential requirements, transportation, communication, and dispute resolution.
With this document you can create either a basic parenting plan, a long distance parenting plan, and/or a highly structured parenting plan. The interactive nature of this document enables you to choose the alternatives that work for your particular situation.
This Parenting Plan will be accepted by courts in the United States.

If there are only one or two issues that divide you and your spouse try to resolve these issues in mediation, which will cost you between $500.00 and $1,000. Once all of your issues are resolved you can enter into a Marital Separation Agreement which makes your divorce uncontested. Once your divorce becomes uncontested, it is simply a matter of processing the paperwork and hearing in an uncontested divorce hearing which usually lasts no more than an hour. In some states a hearing is not necessary.
